Most homeowners do not realize that there is an enormous difference between their originator, servicer and holder. Your originator was a lender and/or broker. These are the entities that may well have violated the law when your loan was made. Your loan often was sold through a securitization to its present holder. The holders have retained a "servicer" to administer your loan.
Servicers have little or no reason to modify a loan as they are paid regardless. The originator has only a very remote interest in what happens to your loan. The entity that cares is the holder which will lose money on an unnecessary foreclosure. Unfortunately, the servicers have, for years, become used to a system in which they would not negotiate modifications. With millions of foreclosures occurring, however, holders, especially when presented with the costs of a litigated foreclosure, are normally supportive of a well considered modification. Almost unbelievably, however, the communication of the desire to modify has not trickled down to the servicers.
